01About these terms

These Terms & Conditions ("Terms") govern your use of the website ecomeal.in and the Ecomeal software and services (together, the "Services") provided by Ecomeal Technologies Private Limited (CIN U62013OD2025PTC049795), a company incorporated in India with its registered office at 1005, Near Kali Temple, Upar Sahi, Laxmisagar, Bhubaneswar, Odisha 751006, India ("Ecomeal", "we", "us", "our").

By creating an account, subscribing, or using the Services, you agree to these Terms on behalf of yourself and the business you represent ("you", "Customer"). If you do not agree, please do not use the Services.

02The Services

Ecomeal provides cloud-based restaurant software accessed through a web browser, including POS billing, kitchen order ticket (KOT) tracking, menu and QR menu management, customer records and loyalty, multi-outlet views, dashboards, reports and AI features such as AI Up Sell and AI Menu Insights. Features may differ by plan and may be updated, improved or changed over time.

03Accounts

  • You must be at least 18 years old and authorised to act for your business.
  • Give accurate information and keep it up to date, including your GSTIN where applicable.
  • Keep your login credentials confidential. You are responsible for activity under your account and your staff's user accounts.
  • Tell us promptly at support@ecomeal.in if you suspect unauthorised access.

04Plans, prices and payment

  • Ecomeal Lite is offered at ₹500 per month + GST when billed monthly (₹5,999 + GST per year), or ₹333 per month + GST when billed annually (₹3,999 + GST per year). Prices on our website are exclusive of GST, which is charged at the applicable rate.
  • Subscriptions are billed in advance for the chosen billing period. Unless you cancel, your plan continues into the next billing period and is billed at the price in effect at that time.
  • Payments are processed by our authorised payment partners. We do not store your full card or bank details.
  • We will give you notice before any price change applies to your subscription.
  • If a payment fails, we may suspend access after notice until the amount is paid.

05Cancellation and refunds

You can cancel at any time. Cancellation stops your next billing; you keep access until the end of the period already paid for. Amounts already paid are not refundable, except for duplicate or erroneous charges. Full details are in our Refund & Cancellation Policy.

06Your data

  • You own the data you and your staff enter into the Services, including menus, orders, sales and your customers' details ("Customer Data").
  • You give us permission to host, process and use Customer Data only to provide, secure, support and improve the Services, and as described in our Privacy Policy.
  • You are responsible for having a lawful basis and any notices or consents needed to collect your guests' personal data and enter it into Ecomeal.
  • You can export your data while your account is active. After your account closes, we may delete Customer Data after a reasonable period, except where the law requires us to keep it.

07AI features

AI Up Sell, AI Menu Insights and similar features generate suggestions, deals and summaries from your sales data. They are tools to help you decide; they are not professional, financial or tax advice. You are responsible for the prices, discounts and offers shown to your guests, and you can close, change or ignore any AI-generated deal at any time.

08Acceptable use

You agree not to:

  • use the Services for anything unlawful, fraudulent or harmful;
  • try to access other customers' data, or to probe, disrupt or overload our systems;
  • copy, resell, reverse engineer or build a competing product from the Services;
  • upload malware or content that infringes anyone's rights.

We may suspend accounts that break these rules, with notice where reasonable.

09Taxes and compliance

You are responsible for your business's tax settings and compliance, including GST rates, invoice details and filings. Ecomeal provides tools to help, but you should confirm your set-up with your chartered accountant.

10Third-party services

The Services may link to or work with third-party services, such as payment gateways, WhatsApp, printers and other integrations. Their own terms apply, and we are not responsible for third-party services.

11Availability and support

We work to keep the Services available and secure, but we do not guarantee uninterrupted or error-free operation. Planned maintenance, internet outages and events beyond our control may cause interruptions. Support is available in the app and at support@ecomeal.in.

12Intellectual property

The Services, software, design, brand names and logos (including "Ecomeal") belong to Ecomeal Technologies Private Limited or its licensors. Your subscription gives you a limited, non-exclusive, non-transferable right to use the Services for your business during your subscription. If you send us feedback, we may use it without obligation to you.

13Disclaimers and limitation of liability

To the extent permitted by law, the Services are provided "as is". We are not liable for indirect, incidental or consequential losses, including loss of profits, revenue or data. Our total liability for any claim relating to the Services is limited to the fees you paid us for the Services in the 12 months before the claim.

14Indemnity

You agree to compensate Ecomeal for losses arising from your breach of these Terms, your misuse of the Services, or Customer Data you did not have the right to use.

15Suspension and termination

You may stop using the Services at any time. We may suspend or end your access if you materially breach these Terms or fail to pay, after giving notice where reasonable. Sections that by their nature should survive (such as payment, data, liability and governing law) survive termination.

16Governing law and disputes

These Terms are governed by the laws of India. We will first try to resolve any dispute informally; write to support@ecomeal.in. Subject to that, the courts at Bhubaneswar, Odisha, have exclusive jurisdiction.

17Changes to these terms

We may update these Terms. We will post the new version on this page with a new "Last updated" date and, for material changes, notify you by email or in the app. Continuing to use the Services after changes take effect means you accept them.
